DISPUTES AROUND BARGAIN IS THE NEW PHENOMENA IN RUSSIAN-JAPANESE TRADE

Sometimes Japanese companies feeling that their Russian partners are not very strict cannot «resist temptation» not to pay for the delivered fish. It is in Japanese press that competition between a great number of unorganized small exporters from Russia decreases prices for their products and destabilizes Japanese market. No wonder that according to Japanese Customs statistics Russians in Japan get for the same amount of fish 2 or 3 times less than their American or Canadian competitors. It is necessary for Russian seamen to make contracts correctly and include arbitration according to the agreement between Chamber of Commerce and Industry of Russian Federation and Japanese Commercial Arbitration Association. If arbitration is provided by the contract, the award is bound for the parties. It is difficult to prove something to the court without independent expertise. As a rule in disorganization avoiding of expertise is advantageous for both the exporter and the importer. But when market is more favourable for the customer, such «carelessness» costs a lot for the seller.
